1. Acceptance of Terms

By using Realest, including our browser extension and website (collectively, the "Service"), you agree to these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Realest provides information about housing complaints for properties in New York City. Our data is sourced from the New York City Department of Housing Preservation & Development (HPD). While we strive to keep this information up-to-date and accurate, we cannot guarantee its completeness or accuracy at all times.

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you may be required to create an account. When creating an account, you must:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept all risks of unauthorized access to your account
  • Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 18 years of age to create an account. By creating an account, you represent and warrant that you meet this age requirement.

3.3 Account Responsibilities

You are responsible for:

  • All activities that occur under your account
  • Maintaining the confidentiality of your account credentials
  • Ensuring that your use of the Service complies with these Terms

3.4 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to:

  • Violation of these Terms of Service
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity

You may delete your account at any time by contacting us at [email protected]. Upon termination, your right to use the Service will immediately cease, and we may delete your account data in accordance with our Privacy Policy.

4. Third-Party Authentication

You may access the Service with Google OAuth. Approving the Google prompt lets us receive your name, email address, and Google user ID so we can manage your Realest account. You must also follow Google's terms, can revoke our access any time in your Google account settings, and we never receive your Google password.

5. Email Communications

By creating an account, you consent to receive transactional emails from us, including:

  • Account verification and confirmation emails
  • Password reset instructions
  • Important service announcements and security notifications

These emails are necessary for the operation of your account and cannot be opted out of while maintaining an active account. We do not send marketing or promotional emails.

6. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service in any way that could damage, disable, overburden, or impair our servers or networks.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Realest and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8. Data Source and Disclaimer

The data provided through our Service is sourced from the New York City Department of Housing Preservation & Development (HPD). We make no claims of ownership over this data. While we strive to present this information accurately, we cannot guarantee its completeness, timeliness, or accuracy. Users should not rely solely on this information for making housing decisions and should verify any critical information independently.

9. No Warranty

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

Realest shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

12. Changes to Terms
